1. Who We Are

These Terms & Conditions (“Terms”) govern your use of deeprestsessions.com (the “Site”) and your purchase of the 35-session digital audio pack and related single-session products (“Products”). By placing an order or using the Site, you agree to these Terms. If you do not agree, please do not use the Site or purchase the Products.

2. Nature of the Product

The Products are downloadable digital audio files (MP3 format) designed for relaxation, rest, and sound-based wind-down purposes. They are not medical devices, medical treatments, or licensed therapeutic interventions, and are not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or medical disorder. Testimonials shown on the Site reflect personal experiences and are not medical claims. If you have a diagnosed sleep disorder, anxiety condition, or other medical concern, consult a qualified healthcare professional before use.

3. Eligibility and Account-Free Purchase

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase Products. No account creation is required; purchases are fulfilled via email delivery of a download link.

4. Pricing, Payment, and Currency

All prices are displayed in US dollars (USD) unless otherwise stated and include any applicable value-added tax (VAT) or sales tax where legally required to be shown.
Payment is processed via third-party payment providers (e.g., Stripe, PayPal). We do not store your full payment card details.
We reserve the right to change prices, discounts, and promotional offers (e.g., launch pricing) at any time without prior notice; changes do not affect orders already completed.

5. Order Confirmation and Delivery

Upon successful payment, you will receive an order confirmation and a download link via email, typically within minutes. It is your responsibility to provide a valid, active email address. If you do not receive your download link within 24 hours, contact studioalberia@gmail.com.

6. Right of Withdrawal (EU/Polish Consumers) — 14-Day Statutory Right & 60-Day Guarantee

6.1 Statutory 14-day withdrawal right (Polish/EU consumers)

If you are a consumer residing in Poland or another EU/EEA member state, you generally have the right to withdraw from a distance contract within 14 days without giving any reason, under the Polish Act of 30 May 2014 on Consumer Rights and EU Directive 2011/83/EU.

However, because our Products are digital content not delivered on a tangible medium, this statutory withdrawal right does not apply once download/access has begun, provided that:

you have given your express, prior consent for us to begin delivering the digital content before the end of the 14-day withdrawal period; and
you have acknowledged that you thereby lose your right of withdrawal; and
we have provided you with confirmation of the contract.

By completing your purchase and confirming that you wish to receive immediate access to the download, you expressly consent to immediate performance and acknowledge the loss of the statutory 14-day withdrawal right once the download link is issued, in accordance with Article 38(13) of the Polish Consumer Rights Act.

6.2 Our voluntary 60-Day No-Pressure Guarantee

Independent of the statutory withdrawal exceptions above, we voluntarily offer all customers, regardless of country, a 60-day money-back guarantee. If the Products do not feel like the right fit for you, simply email studioalberia@gmail.com within 60 days of purchase to request a full refund. No reason, form, or explanation is required. Refunds are processed to the original payment method, typically within 14 business days of the request.

6.3 US and Canadian customers

We do not currently maintain a separate statutory return framework for digital-only goods in the US or Canada (most US states and Canadian provinces do not mandate cooling-off periods for digital downloads); our 60-day guarantee described in Section 6.2 applies equally to all customers regardless of location, and constitutes your primary remedy for a change of mind or dissatisfaction.

7. License Grant and Permitted Use

Upon purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use the Products for your own personal, non-commercial use on devices you own or control. You may not:

resell, sublicense, rent, lease, or redistribute the Products or any part of them;
upload the Products to any file-sharing service, public platform, streaming service, or social media;
use the Products in any commercial context (e.g., in a spa, studio, app, YouTube video, or public playback) without our prior written consent;
reverse engineer, remix, sample, or create derivative works from the audio for redistribution.

We retain all intellectual property rights, including copyright, in the Products. Unauthorized use may result in termination of your license and legal action.

8. Guarantee Claims and Refund Process

To request a refund under the 60-day guarantee, email studioalberia@gmail.com with your order confirmation/receipt. We aim to process eligible refund requests within 14 business days.

Upon refund, your license to use the Products terminates, and you agree to delete all downloaded files.

9. No Subscription

All purchases described on the Site are one-time, single payments. We do not enroll customers in recurring billing or subscriptions for the Products described herein.

10. Availability and Technical Requirements

You are responsible for ensuring you have a device, storage capacity, and MP3-compatible software to download and play the files. We are not liable for failures caused by your hardware, software, internet connectivity, or email provider (including spam filtering).

11. Disclaimer of Warranties

The Products are provided “as is” and “as available.” Except for the express guarantee in Section 6.2, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. Nothing in this section limits any statutory consumer rights that cannot be lawfully excluded in your jurisdiction (e.g., under Polish Civil Code warranty/”rękojmia” provisions for defective digital content, or equivalent consumer-protection statutes in the US and Canada).

12. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from your purchase or use of the Products is limited to the amount you paid for the Product giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including any claim that the Products did not produce a particular health, sleep, or relaxation outcome.

13. Complaints (Poland/EU Consumers)

If you are a Polish or EU consumer and wish to file a complaint regarding a defect in the digital content, you may do so by emailing studioalberia@gmail.com. We will respond within 14 days. You may also use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr, or contact your local consumer ombudsman (e.g., Polish UOKiK).

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory consumer-protection provisions of the country in which you reside as a consumer (including EU, US state, or Canadian provincial law that may apply to you and cannot be excluded by contract). Any dispute not resolved amicably or via ODR shall be subject to the competent courts of Poland, unless mandatory consumer law in your country of residence grants you the right to bring proceedings in your local courts.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
